Discretion on a project\u2019s classification lies with the agencies overseeing its completion.<\/p>\n<p>Now, &#8216;cumulative\u201d and \u201cindirect&#8217; effects are no longer required for agencies\u2019 consideration. They will have two years for environmental impact statements (EISs).\u00a0<\/li>\n<li><b>Project standards<\/b> When several federal agencies have authority over a submitted project, they must organize their timeline for construction so that they do not accidentally overlap during construction. If possible, they must submit a single document describing each agency\u2019s involvement, record of a combined decision, and finding of no significant impact <a href=\"https:\/\/www.natlawreview.com\/article\/ceq-issues-final-rule-to-modernize-nepa-regulations\">(FONSI)<\/a>.\u00a0<\/li>\n<li><b>Restrictions<\/b> The rule slightly tightens restrictions on categorical exclusions. These are circumstances that might allow agencies to skip the review of the environmental impact. It may not have a significant effect, but agencies may now use other agencies\u2019 categorical exclusions legitimately.<\/li>\n<li><b>A win for Native Americans<\/b> The new NEPA requires federal agencies to further incorporate Native American communities into NEPA reviews. This allows them to stand as <a href=\"https:\/\/www.natlawreview.com\/article\/ceq-issues-final-rule-to-modernize-nepa-regulations\">cooperating agencies<\/a>. It also requires their input on NEPA review timelines.\u00a0<\/li>\n<li><b>Information over involvement<\/b> The new rule cuts the 30-day public comment period that typically follows the release of the environmental impact statement (EIS). Agencies now have more control over whether or not public meetings or hearing are necessary. Now, the law emphasizes the <a href=\"https:\/\/www.natlawreview.com\/article\/ceq-issues-final-rule-to-modernize-nepa-regulations\">disclosure<\/a> of information to the public over public involvement.<\/li>\n<\/ol>\n<p><\/p>\n<p><\/p>\n<h2><strong>The Nitty-Gritty of the White House\u2019s New Rule<\/strong><\/h2>\n<p><\/p>\n<p><\/p>\n<p>The statute <a href=\"https:\/\/www.nrdc.org\/experts\/sharon-buccino\/understanding-trumps-harmful-attack-nepa\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"undefined (opens in a new tab)\">applies<\/a> to &#8216;major federal actions&#8217;, and courts abbreviated NEPA to interpret this term <a href=\"https:\/\/www.nrdc.org\/experts\/sharon-buccino\/understanding-trumps-harmful-attack-nepa\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"undefined (opens in a new tab)\">broadly<\/a>.<\/p>\n<p><\/p>\n<p><\/p>\n<p>Therefore, the Trump administration may pick and choose which of its projects count as &#8216;major federal actions&#8217;.
